Luckee Terms of Use

1. Introduction
1.1 Purpose of the Agreement
This Terms of Use Agreement (the “Agreement”) is made and entered into by you and Luckee Gaming Platform Ltd., its subsidiaries, and affiliates.. This Agreement sets forth the terms and conditions that govern your use of and access to our Platform and Services. By accessing or using the Platform which include our various websites (and any respective subdomains); applications (collectively with any materials and services available therein, and successor website(s) or application(s), and other services that link to these terms, as well as any information, text, links, graphics, photos, audio, video, or other materials stored, retrieved or appearing thereon, whether accessed through the site or otherwise, you signify that you have read, understand, and agree to be bound by this Agreement, our Privacy Notice, and any other policies referenced herein in their entirety.
IF YOU DO NOT AGREE, YOU ARE NOT AUTHORIZED TO ACCESS OR USE THE PLATFORM AND SHOULD NOT USE THE PLATFORM.
1.2. Definitions of Key Terms
- “Account” refers to the Account created by you to access and use the Platform or Services.
- “Agreement, Terms of Use, Terms”refers to this Terms of Use as a whole.
- “Data Protection Legislation” refers to the Nigeria Data Protection Act 2023 (NDPA) and all other applicable legislations, regulations and other regulatory requirements in force from time to time which apply to a party, all relating to the use of Personal Data.
- "Game" refers to any form of betting, gambling, or interactive entertainment offered on the Platform.
- “Luckee”, “us”, “we” or “our”, refers to Luckee Gaming Platform Ltd., and its affiliates, subsidiaries, officers, directors, employees, agents, and licensors.
- “Personal Data” refers to any information that can be used to identify a living person including email address, company name, password, payment card, financial information such as (bank account number, etc.), government-issued identity card and/or taxpayer identification. It may also include anonymous information that is linked to you, for example, your internet protocol (IP) address, log-in information, address, location, device, or transaction data.
- "Platform" refers to our website, mobile application, or API and includes our Services.
- “Services” or “Service” refer to our products, services, information, content, functions, features, and tools provided on our Platform.
- “Stake Price” refers to the amount of money that you risk or invest on a specific bet or gaming outcome.
- "Third-Party Services" refers to services or applications provided by entities other than Luckee that may be linked to or integrated within the Luckee Platform.
- "User," "you," and "your" refers to you, the individual or entity accessing and using our Platform and agreeing to this Terms of Use.
- "User-Generated Content" refers to content that is created and submitted by Users of the Luckee Platform, which may include comments shared on our community platform, reviews, posts, bug reports, ideas, feedback, and any other material shared within the community or to Luckee.
- "Wallet" refers to the user's personal account on the Platform where funds are stored, and from which deposits are made for gaming activities and to which winnings are credited.
2. Your Eligibility to Use Our Platform
To access or use the Platform, you must be able to form a legally binding contract with us. Accordingly, you affirm that you are at least the age of majority in your jurisdiction and have the full right, power, and authority to enter into and comply with the terms and conditions of this Agreement on behalf of yourself and any company or legal entity for which you may access or use the Interface. Furthermore, you affirm that your access and use of the Platform will fully comply with all applicable laws and regulations and that you will not access or use the Platform to conduct, promote, or otherwise facilitate any illegal activity. You also affirm that you have not been previously suspended or removed from using our Platform for any reason. If you do not meet the above requirements, you must not use our Platform. We reserve the right to refuse service, terminate Accounts, or limit access to our Platform for any user who does not meet these eligibility requirements or for any other reason at our sole discretion.
3. Creating an Account With Us
3.1. Your Account Creation Process
To access the full range of Services offered on our Platform, you must create an Account. The Account creation process includes the following steps:
a. Information Submission – You agree to provide accurate, current, and complete information during the registration process. This may include:
- Full legal name
- Date of birth
- Email address
- Phone number
- Gender
b. Verification – You agree to verify your email address and phone number as part of the registration process.
c. Password Creation – You will be required to create a strong, unique password for your Account. We recommend using a combination of uppercase and lowercase letters, numbers, and symbols.
d. Transaction PIN Creation – You will be required to create a unique four digit pin to manage approval of transactions in your Wallet.
e. Terms Acceptance – You must explicitly agree to these Terms of Use, our Privacy Notice, and any other applicable policies.
f. KYC Verification – Depending on your location and the Services you wish to access, you may be required to complete our Know Your Customer (KYC) verification process immediately upon registration or at a later stage.
You are responsible for keeping your Account information up to date. Failure to maintain accurate, current, and complete Account information may result in your inability to access or use our Platform or the termination of your Account.
You are not permitted to allow any family member or relative to use your Account. If you provide any Personal Information of any family member or relative through your Account for the purposes of the Services offered, you acknowledge and agree that such conduct constitutes the affirmative acknowledgement and agreement of the particular family member and their consent to these Terms and our Privacy Notice.
3.2. Know Your Customer (KYC) and Identity Verification
We are committed to preventing fraud, money laundering, terrorist financing, and other financial crimes. To this end, we implement robust Know Your Customer (KYC) and identity verification procedures.
Depending on your location, the services you use, and the volume of your transactions, you may be required to provide the following:
- a. Your Bank Verification Number (BVN)
- b. Your local bank account details
- c. Any other additional documentation to verify your source of funds
We may further implement different verification levels with varying requirements and transaction limits. Higher verification levels may require more extensive documentation and checks. We reserve the right to request updated or additional KYC information at any time during your use of our Platform.
We may use third-party service providers to verify your identity and conduct background checks. By using our Platform, you authorize us to make inquiries, whether directly or through third parties, that we consider necessary to verify your identity or protect you and/or us against fraud or other financial crimes.
We reserve the right to refuse service, suspend or terminate Accounts, or limit access to our Platform for users who do not complete our KYC and identity verification process to our satisfaction.
We treat all information collected during the KYC process with the utmost confidentiality and in accordance with our Privacy Notice.
3.3. Your Account Security Responsibilities
The security of your Account is crucial, and you play a vital role in maintaining this security. By creating an Account, you agree to the following security responsibilities:
a. You are responsible for maintaining the confidentiality of your Account password. We recommend the following password best practices:
- Use a unique password for your Account.
- Include a mix of uppercase and lowercase letters, numbers, and symbols.
- Avoid using easily guessable information (e.g., birthdays, names).
- Change your password regularly, at least once every three months.
b. You can ensure device and session security by:
- always logging out of your Account when using a shared or public device.
- not sharing your Account credentials with anyone.
- being cautious when you access your Account on public Wi-Fi networks.
c. You must be alert to phishing attempts. Luckee will never ask for your password via email, phone, or any other means outside of our official Platform.
d. You must notify us immediately if you suspect any unauthorized access to your Account or any other breach of security. You can contact us at support@luckee.ng or through our dedicated support channels.

e. You must regularly review your Account activity and transaction history. Report any suspicious transactions to us immediately.
f. You are to keep your devices and software up to date with the latest security patches and updates.
You acknowledge that Luckee will not be responsible for any loss or damage arising from your failure to comply with these security responsibilities.
We reserve the right to suspend or terminate Accounts that we believe have been compromised or are being used in a manner that violates these Terms or poses a security risk.
4. Products We Offer
We provide a Platform which provides users access to an online community that revolutionizes the gaming experience through social interactions and financial transactions. Every Participant has an equal opportunity to win through our independent algorithm.
4.1 Our Games
4.1.1 Options and Terms
You have the liberty to choose from seven (7) Game options. These Games include:
a. Quick Draw – Participants are randomly matched and paired with other real-time participants across the globe, and winners are decided randomly by an independent selection algorithm. To play, select your Stake Price from the available stakes and get automatically paired in real-time.
b. Factoes – Users are allowed to trade and wager on listed topics of interest prior to the verification date and time or before the outcome holds true. Topics are categorized as either facts or opinions. Topics are published on the site after proper vetting for flaws or bias by our risk managers.
c. Numbers – Participants are allowed to choose from a range of 1–80. At least one (1) number can be chosen and a maximum of four (4) numbers combined. Winners are made when participants' prediction tallies (matches) with any of the house published numbers, either by a single number or via combination.
d. Pacesetter – Participants are allowed to answer random quiz questions from a variety of fields within a fixed timeframe. This game is simply a test of the participant’s knowledge and versatility. Winners are automatically determined by our independent algorithm, which keeps track of and records participants' performances. Performance here is measured by the number of questions correctly answered within the fixed time by each participant. The topmost rank on the scoreboard is selected as the winner by our algorithm at the closure of each session. The session’s duration is subjected to change. Users will be updated beforehand before effecting an extension or a reduction in session duration.
e. Pacesetter – Participants are allowed to answer random quiz questions from a variety of fields within a fixed timeframe. This game is simply a test of the participant’s knowledge and versatility. Winners are automatically determined by our independent algorithm, which keeps track of and records participants' performances. Performance here is measured by the number of questions correctly answered within the fixed time by each participant. The topmost rank on the scoreboard is selected as the winner by our algorithm at the closure of each session. The session’s duration is subjected to change. Users will be updated beforehand before effecting an extension or a reduction in session duration.
f. Wishlist – Participants can choose what they want from the available options. A fixed number of winners are drawn at random automatically at the closure of each season.
Each game or betting option on the Platform has its own specific rules, which are provided within the game interface. You are responsible for familiarizing yourself with these rules before participating.
A Stake Price will be automatically deducted from your wallet on selecting to participate in any of the games after following all the required process prompts. The Stake Price varies depending on the category of the game you have selected. Stake Prices are subject to variation depending on regulation by governing bodies. Also, we may change Stake Prices to adjust to economic changes. You acknowledge that all Stake Prices are totally non-refundable. Once you click proceed, the required Stake Price will be deducted from your wallet to participate in the draw. Where a draw has been unmatched or unfilled, you may exit the draw and receive a refund of your Stake Price only after 48 hours.
We reserve the right to modify, supplement or terminate all or part of these Games at any time without notice to you and without liability of any kind, except with regard to winnings that have legitimately accrued and that we have recognized before the date of such modification, supplement or termination.
We also reserve the right to replace the advertised prizes with prizes of the same or greater value at our sole discretion. Where you have won a Game, we have the right to publish your name and/or photographs in any media or promotional material produced by us. Such use does not entitle you to any further compensation.
4.1.2 Fairness and Transparency in Gaming
Luckee is committed to ensuring fair play and transparency in all gaming activities. We use certified random number generators and regularly audit our systems to maintain integrity. Every service offered by Luckee is either automated or quasi-automated as outcomes are decided by an independent algorithm
There is no house and revenue is generated from the commission we charge for every Game you participate in.
4.1.3 Responsible Gaming Practices
Luckee is committed to promoting responsible gaming and ensuring a safe gaming environment for all users. To support this commitment, Luckee provides the following tools and resources:
a. Loss Threshold Notification System – We recognize that experiencing a series of consecutive losses can be distressing for users and may lead to impulsive decisions or increased gambling behavior. To mitigate these risks, you have the option of allowing us to monitor your betting activity to track consecutive losses. Once you reach your predefined threshold of consecutive losses, the Platform triggers an alert to notify you of your current streak. This proactive approach allows you to reflect on your gaming behavior and consider taking a break if necessary.
You are strongly encouraged to utilize these tools and resources to manage your gaming activities responsibly.
4.1.4 Abuse and Disqualification from Games
You may be disqualified at any stage of the Game, for any, but not limited to the following reasons:
a. Failure to comply with or observe these Terms;
b. You are an employee of Luckee and/or any company directly collaborating with Luckee for the purpose of executing raffles and trades;
c. You are the spouse, direct family member, relative of direct kinship of an employee of Luckee and/or any company directly collaborating with Luckee for the purpose of executing raffles and trades;
d. You are a person in a position to benefit illegitimately from unpublished or privileged information connected to Game;
e. You are a person in a position to interfere with the operation of the Game (legitimately or illegitimately);
Where you have already won a Game, you may also be disqualified for any but not limited to the following reasons:
a. You do not provide any proper identification documents required by these Terms;
b. You lack legal capacity or are under-aged;
c. You are related directly or indirectly with Luckee;
d. You are seen or found to have participated in the Game by way of fraud, deceit or in any manner which contravenes the spirit and intent of the Games, these Terms, or in a manner prejudicial and/or unfair to other Users.
4.2 Our Wallet Feature
Luckee provides users with a wallet feature within the Platform that allows for the seamless transfer of funds between user Accounts. You can send money to other user wallets using unique nicknames, enhancing the convenience and social interaction within the platform. When using the wallet feature, you agree to:
a. Ensure that the nickname used for transactions accurately represents the intended recipient. We will not be responsible for any errors resulting from incorrect nickname entries.
b. Maintain the confidentiality of your account details, including passwords and sensitive information.
c. Adhere to all applicable laws and regulations regarding financial transactions, including anti-money laundering laws. You must ensure that funds sent or received do not originate from illegal activities.
At our discretion, we may impose limits on the amount of money that can be sent or received through the wallet feature. Any applicable fees associated with transactions will be clearly disclosed prior to completion.
4.3. Our Social Features and Community Interactions
4.3.1 Rules for Social Interactions
When interacting with other users within the Luckee Community, you agree to adhere to the following rules:
- Respectful Communication: Engage in discussions respectfully and constructively. Disagreements should be handled with civility and open-mindedness.
- No Spamming or Self-Promotion: Avoid spamming, excessive self-promotion, or disruptive behavior that detracts from the community experience. This includes posting irrelevant links or repeatedly promoting personal content without permission.
- Respect Privacy: Respect the privacy and personal boundaries of other users. Do not share personal information about others without their consent.
4.3.2 Prohibition of Cyberbullying
Luckee is committed to fostering a safe and respectful gaming environment. Any form of cyberbullying is strictly prohibited on the platform. Cyberbullying includes harassment, intimidation, threats, or any behavior intended to harm, embarrass, or distress another user through digital communication.
4.3.3 Guidelines for User-Generated Content
To ensure you have complete social gaming experience, we have ensured that you have the opportunity to create and share content within our Community. All of such user-generated content must adhere to the following standards:
- Originality: Content must be original or properly attributed to the rightful owner. Plagiarism or unauthorized use of others' work is strictly prohibited.
- Respect for Rights: Content must not infringe on any third-party rights, including intellectual property rights, privacy rights, or any other legal rights.
- Appropriateness: Content must not contain offensive, discriminatory, or inappropriate material. This includes hate speech, harassment, or any content that promotes violence or discrimination against individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other characteristic.
- Legal Compliance: All content must comply with applicable laws and regulations. Users are responsible for ensuring that their contributions do not violate any local, national, or international laws.
4.3.4 Inappropriate Behavior in the Community
Luckee works diligently to protect the safety, security, integrity, and proper use of our platform. This includes addressing harmful conduct towards others and violations of our Terms and policies. We take situations involving abusive behavior seriously and will take appropriate action if we learn of such incidents.
If you encounter cyberbullying or other inappropriate behavior within our community, report it immediately through our reporting mechanisms. Users found to be engaging in cyberbullying or related actions will face immediate consequences, which may include account suspension or termination and potential reporting to relevant authorities.
Luckee reserves the right to take necessary actions to ensure a safe environment for all users. This may include removing offending individuals from the platform and contacting law enforcement when necessary. Any such removal will be conducted in accordance with the procedures outlined in Section 14.
5. Payments
5.1 Deposits and Withdrawals
We have partnered with licensed payment gateways to enable us to receive payments and disburse payments. You may deposit and withdraw funds from your Wallet using these approved payment methods. You are required to pay any withdrawal charges imposed by our partnered payment gateways. We are not liable for any breach or compromise of your Wallet. We strongly recommend that you report any breaches to your account as soon as possible via the available communication channel.
All deposits and withdrawals are subject to verification procedures designed to ensure security and compliance with applicable anti-money laundering regulations. You may be required to provide documentation to verify your identity and the source of funds, particularly for larger transactions. This process is in place to protect both you and the integrity of the Luckee platform.
5.2 Currency and Payment Methods
Luckee primarily operates in Nigerian Naira (NGN). Accepted payment methods may include:
- Bank transfers
- Mobile money services
- Select cryptocurrencies – Stablecoins (USDT and others)
You are encouraged to review the full list of accepted payment methods available on the Platform, as these may be updated periodically at our discretion. Additionally, any conversions from cryptocurrency to Nigerian Naira will adhere to the Central Bank of Nigeria's exchange rates, and applicable charges may apply.
5.3 Fees and Charges
Luckee strives to minimize fees for users engaging in financial transactions on the platform. Any applicable fees associated with deposits or withdrawals will be clearly displayed before a transaction is completed, ensuring transparency. Users are responsible for any fees charged by their payment providers, which may vary based on the chosen payment method. Luckee will not be liable for any additional charges incurred by users as a result of using third-party payment services.
6. Regulatory Compliance
Luckee is committed to complying with all applicable laws, rules, and regulations, including anti-money laundering (AML) and know-your-customer (KYC) regulations. We may be required to collect and verify certain information about you as part of our KYC procedures. You are also responsible for complying with all applicable tax laws and regulations related to your use of the Luckee platform. Luckee does not provide tax advice, and it is recommended that you consult with a tax professional regarding your specific circumstances.
7. Risks and Disclaimers
We disclaim any ongoing obligation to notify you of all of the potential risks of using and accessing our Platform. You agree to accept these risks and assume full responsibility for any losses or damages arising from the use of the Platform. Luckee will not be liable for any losses or damages arising from these risks or be required to indemnify any third party responsible for any consequent losses.
7.1 Market Risks
The gaming industry is subject to fluctuations in market demand, competition, and regulatory changes. We cannot guarantee the availability of specific games or features, nor can it assure you of consistent participation levels or profitability. You should be aware that changes in market conditions may affect your gaming experiences.
7.2 Technology Risks
a. System Failures: There is a risk of technical failures, errors, or malfunctions affecting the Luckee platform. This includes potential hardware or software failures, internet connectivity issues, or other disruptions that may impede your ability to access the platform or participate in gaming activities.
b. Cybersecurity Risks: While Luckee takes data protection seriously and implements reasonable security measures, no system can be entirely secure from cyber threats. You acknowledge that there is a risk of data breaches, hacking, or other cyber incidents that could compromise your personal information or account security. Luckee disclaims any liability for damages resulting from such incidents.
Our responsibility is strictly limited to providing prizes and ensuring the availability of unbiased gaming software. We cannot be held liable for any delays or failures in sending or receiving SMS or email messages due to technical issues beyond our control. This includes issues arising from your internet service provider, mobile carrier, or any third-party communication services. Except in cases of force majeure, such as power supply disruptions, we will give our best to procure the necessary technical equipment and develop the software required for the Platform. However, we disclaim any responsibility for technical or network failures caused by third-party partners. Any claims made by you will be addressed by Luckee if deemed well-founded.
7.3 Financial Risks
Luckee acknowledges that participation in gaming activities involves financial risks. You may experience losses that exceed your initial stake, and Luckee is not liable for any financial losses incurred while using the Platform. You are encouraged to gamble responsibly and only wager amounts you can afford to lose.
7.4 Information Risk
Any information presented on or through the Platform is made available for general information purposes only. We do not warrant the accuracy, completeness, suitability, or quality of any such information. Any reliance on such information is strictly at your own risk. We also disclaim all liability and responsibility arising from any reliance placed on such information by you, any other user of the Platform, or anyone who may be informed of any of its contents.
7.5 Third-Party Services Disclaimer
Our Platform may also contain links to Third-Party Services. Third-Party Services are not under the control of Luckee and Luckee is not responsible for Third-Party Services or for any information or materials on, or any form of transmission received from, any Third-Party Service. The inclusion of a link does not imply endorsement by Luckee of the Third-Party Services or any association with the operators of the Third-Party Services. We do not investigate, verify, or monitor the Third-Party Services. We provide links to Third-Party Services for your convenience only and you access these Third-Party Services at your own risk. If you decide to use these third-party services or participate in any promotions, you do so at your own risk and you understand that this Agreement does not apply to your dealings or relationships with any third parties. You will be responsible for reviewing and understanding the terms and conditions associated with them. You expressly relieve us of any and all liability arising from your use of any such resources or participation in any such promotions.
7.6. Warranty Disclaimer
The Services and Platform are provided on an "AS IS" and "AS AVAILABLE" basis. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ANY REPRESENTATIONS AND WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. You acknowledge and agree that your use of the Platform is at your own risk. We do not represent or warrant that access to the Platform will be continuous, uninterrupted, timely, or secure; that the information contained in the Platform will be accurate, reliable, complete, or current; or that the Platform will be free from errors, defects, viruses, or other harmful elements. No advice, information, or statement that we make should be treated as creating any warranty concerning the Platform. We do not endorse, guarantee, or assume responsibility for any advertisements, offers, or statements made by third parties concerning the Platform.
7.7 Participation at Your Own Risk
Participation in the Games is entirely at your risk. Under no circumstances shall Luckee be liable for any direct, indirect, incidental, or consequential damages arising from your participation in the Games, including but not limited to loss of income, data, or other information resulting from the use of or inability to use the Games.
8. How We Manage Your Data
Protecting your personal data is a key aspect of our relationship with you and is required of us by relevant Data Protection Regulation. Whenever you use our Platform, you consent to the collection, storage, transfer, and use of your personal data as described in our Privacy Notice. This includes any information you choose to provide that is deemed sensitive under applicable laws and regulations. Please review our Privacy Notice in order to better understand our commitment to maintaining your privacy and protecting your data, as well as the terms on which we process any personal information that we collect from you or that you provide to us. The Privacy Notice is available on our website at https://www.luckee.ng. By using the Platform, you agree to the Privacy Notice and consent to the processing of any personal data described in the Privacy Notice and you warrant that all data that you provide to us is accurate.
9. Intellectual Property
9.1. Our Intellectual Property
All content on the Platform is the property of Luckee or its licensors and is protected by intellectual property laws. This includes:
a. Trademarks: The Luckee name, logo, Game names, features within the Games, and any other product or service names, logos, or slogans that may appear on our Platform are trademarks of Luckee and may not be copied, imitated, or used, in whole or in part, without our prior written permission
b. Copyright: All content on our Platform, including text, graphics, user interfaces, visual interfaces, photographs, artwork, computer code, and other materials, is protected by copyright laws.
c. Patents: Certain aspects of our Platform and Services may be protected by patents owned by Luckee or its affiliates.
d. Trade Secrets: Our Platform incorporates proprietary information and trade secrets that are confidential and protected by law.
We do not grant you any right, license, title or interest to any of our Intellectual Property Rights which you may or may not have access to. You agree not to modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit any of our intellectual property in whole or in part except as expressly authorized by us. Any use of our intellectual property for any purpose not expressly permitted by these Terms is strictly prohibited. You agree to take such actions including any legal or official document or other documents that may be needed to further affirm our intellectual property rights.
9.2 Your License to Use our Platform
Subject to these Terms, Luckee grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our Platform for its intended purposes. Unless otherwise provided by applicable law, you agree not to alter, re-design, reproduce, adapt, display, distribute, translate, disassemble, reverse engineer, or otherwise attempt to create any source code that is derived from the software. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information of Luckee without our express written consent. You may not use any meta tags or any other "hidden text" utilizing Luckee's name or trademarks without our express written consent. Any unauthorized use terminates the permission or license granted by Luckee. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the homepage of Luckee so long as the link does not portray Luckee or its Services in a false, misleading, derogatory, or otherwise offensive matter. You agree that we are free to use or not use any User Generated Content by you as we see fit, including copying and sharing such content with third parties, without any obligation to you.
10. Service Interruptions
As a condition to accessing or using the Platform or the Services, you acknowledge, understand, and agree that from time to time, the Platform may be inaccessible or inoperable for any reason, including equipment malfunctions, periodic maintenance procedures or repairs, causes beyond our control or that we could not reasonably foresee, disruptions and temporary or permanent unavailability of underlying algorithms or unavailability of third-party service providers or external partners for any reason.
11. Your Responsibilities and Prohibited Activities

As a user of our Platform, you have certain responsibilities and obligations. You agree to:
a. use our Platform in compliance with these Terms, our Privacy Notice, and all applicable laws, rules, and regulations in your jurisdiction.
b. maintain the security of your account by keeping your login credentials confidential and using strong authentication methods.
c. provide accurate, current, and complete information when creating your account and keep this information updated throughout your use of our Platform.
d. use our Platform responsibly and ethically. This includes making informed decisions about your financial transactions and understanding the risks associated with gambling and betting activities.
e. promptly report any security issues, unauthorized access to your account, or other problems you encounter while using our Platform.
f. pay all applicable fees associated with your use of our Platform in a timely manner.
g. maintain a valid email address and other contact information in your account settings to receive important notifications about your account and our Platform.
h. acknowledge and understand the risks associated with gambling activities, including potential loss of funds.
11.2 Prohibited Activities
To maintain the integrity, security, and legality of our Platform, the following activities are strictly prohibited:
a. Using our Platform in any manner that violates any applicable local, state, national, or international law or regulation.
b. Engaging in any fraudulent, deceptive, or misleading practices, including providing false or inaccurate information.
c. Attempting to gain unauthorized access to other users' accounts or any part of our Platform's infrastructure.
d. Introducing or attempting to introduce viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material to our Platform.
e. Engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to our Platform, or while using our Platform.
f. Doing anything that interferes with, disrupts, or negatively affects the functioning of our Platform or other users' experience.
g. Doing anything to influence our independent algorithm and influence winnings for yourself or any other User on the Platform.
h. Attempting to circumvent any content-filtering techniques we employ or attempting to access areas or features of the Platform that you are not authorized to access.
i. Impersonating or attempting to impersonate Luckee, a Luckee employee, another user, or any other person or entity.
j. Using our Platform to engage in money laundering, terrorist financing, or any other illegal activities.
k. Using our Platform in a manner that infringes upon or violates the intellectual property rights or other rights of any third party.
l. Using our Platform to transmit any unsolicited or unauthorized advertising, promotional materials, 'junk mail', 'spam', 'chain letters', 'pyramid schemes', or any other form of solicitation.
m. Using our Platform for any form of cyber bullying or harassment.
n. Using our Platform in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Platform.
o. Accessing or using our Platform through any automated means, including through the use of robots, spiders, or offline readers.
p. Creating or operating multiple accounts to evade restrictions, limits, or suspensions, or to abuse promotional offers or other features.
Luckee reserves the right to monitor user activity and enforce these prohibitions at our discretion. If we determine that you have engaged in any prohibited activity as listed above, we may address such prohibited activity through an appropriate sanction in our sole and absolute discretion. Such sanction may include, but is not limited to, making a report to any Government, law enforcement, or other authorities, without providing any notice to you about any such report; confiscation of any fiat, funds, property, proceeds, in the Account which you have with us; and, suspending or terminating your access to the Platform or fiat, funds, property, proceeds in the Account which you have with us. We may, at our sole and absolute discretion, seize and deliver these to any applicable Government, law enforcement, or other authorities where circumstances warrant. In addition, should your actions or inaction result in the imposition of economic costs to us, you shall pay an amount to us so as to render us whole, including without limitation, the amount of taxes or penalties that might be imposed on us as a result of your prohibited activity.
11.3 Reporting Suspicious Activities
As part of our commitment to maintaining a safe and compliant Platform, we require users to report any suspicious activities they encounter. This includes:
a. Any transactions or activities that you believe may be fraudulent or illegal.
b. Any signs that your Account or another user's Account may have been compromised.
c. Any suspected phishing attempts or unauthorized communications claiming to be from Luckee.
d. Any security vulnerabilities or bugs you discover in our Platform.
e. Any activities by other users that you believe violate these Terms of Use.
To report suspicious activities, please contact our support team immediately at support@luckee.ng or through our dedicated support channels. We will investigate all reports promptly and take appropriate action.
12. Limitation of Liability
12.1. The Scope of Our Liability
UNDER NO CIRCUMSTANCES SHALL WE OR ANY OF OUR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, OR SUBSIDIARIES BE LIABLE TO YOU FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE PROPERTY, ARISING OUT OF OR RELATING TO ANY ACCESS OR USE OF THE PLATFORM, NOR WILL WE BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE PLATFORM OR THE INFORMATION CONTAINED WITHIN IT. WE ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY: (A) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (B) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM ANY ACCESS OR USE OF THE PLATFORM; (C) UNAUTHORIZED ACCESS OR USE OF ANY SECURE SERVER OR DATABASE IN OUR CONTROL, OR THE USE OF ANY INFORMATION OR DATA STORED THEREIN; (D) INTERRUPTION OR CESSATION OF FUNCTION RELATED TO THE PLATFORM; (E) BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE INTERFACE; (F) ERRORS OR OMISSIONS IN, OR LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF, AND ANY CONTENT MADE AVAILABLE THROUGH THE PLATFORM. UNDER NO CIRCUMSTANCES SHALL WE OR ANY OF OUR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, OR SUBSIDIARIES BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES, OR COSTS IN AN AMOUNT EXCEEDING ₦100,000. THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITY.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of certain liabilities and damages. Accordingly, some of the disclaimers and limitations set forth in this Agreement may not apply to you in their entirety but will apply to the fullest extent permitted by law.
12.2. Indemnification
You agree to hold harmless, release, defend, and indemnify us and our officers, directors, employees, contractors, agents, affiliates, and subsidiaries from and against all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
a. your access and use of the Platform and our Services;
b. your violation of any term or condition of this Terms, the right of any third party, or any other applicable law, rule, or regulation; and
c. any other party's access and use of the Platform with your assistance or using any device or account that you own or control.
12.3. Force Majeure
We shall not be liable for any failure or delay in performance of our obligations under these Terms to the extent that such failure or delay is caused by or results from events beyond our reasonable control. Such events include, but are not limited to, acts of God, fire, flood, earthquake, storm, hurricane, other natural disasters, war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot, civil commotion, embargoes, sanctions, labor disputes, strikes, lockouts or other industrial action, shortages of labor or materials, transportation difficulties, interruptions or failures of utilities or telecommunications services, or acts of government or any other authority. If such an event occurs, we shall promptly notify you in writing of the occurrence and its anticipated duration. We will ensure to use commercially reasonable efforts to mitigate the effects of the Force Majeure Event.
13. Dispute Resolution
13.1 User Complaints Process
You must first contact Luckee if a dispute arises between you and Luckee. Our goal is to learn about and address your concerns and, if we are unable to do so to your satisfaction, we will provide you with a neutral and cost effective means of resolving the dispute quickly. Disputes between you and Luckee regarding our Platform and Services may be reported to support@luckee.ng at any time.
13.2 Mediation
If a Party determines after negotiating in good faith for a period of fourteen (14) days, that any disputes or differences which may arise between the parties out of this Agreement cannot be resolved through negotiation, such matters shall be settled by mediation. Online mediation processes may be deployed. If mediation also fails or both parties fail to agree on a mediator within another 14 days after the initial 14 days, parties shall apply to Lagos Multi Door Court House (LMDC) for dispute resolution under the LMDC Mediation Procedure Rules or such other rules mutually agreed by the Parties. The proceedings shall be conducted in English Language and the Laws of the Federal Republic of Nigeria shall apply.
13.3 Arbitration
Where dispute resolutions under this clause above have been explored; if unsatisfied, a party requesting for relief shall, except for claims seeking injunctive or other equitable relief, resolve the dispute in a cost-effective manner through binding non-appearance-based arbitration. Where a party elects arbitration, that party will initiate such arbitration through an arbitrator mutually agreed upon by the parties. The arbitrator and the parties must comply with the following rules: (a) the arbitration shall be conducted by telephone, online, and/or be solely based on written submissions. The specific manner shall be chosen by the party initiating the arbitration; (b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and (c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Except as otherwise agreed by the parties or as described in this provision, you agree that any claim or dispute you may have against Luckee must be resolved by a court located in Nigeria or where the defendant is located. You agree to submit to the personal jurisdiction of the courts located within Nigeria for the purpose of litigating all such claims or disputes. This Agreement shall be governed in all respects by the laws of Nigeria as such laws are applied to agreements entered into and to be performed entirely within Nigeria, without regard to conflict of law provisions. All Alternative Dispute Resolution (ADR) proceedings and all information submitted, relating to or presented in connection with or during the proceeding, shall be deemed confidential information not to be disclosed to any person not a party to the proceedings. All communications, whether written or oral, made in the course of or in connection with the Claim and its resolution, by or on behalf of any party or by the arbitrator or a mediator, including any arbitration award or judgment related thereto, are confidential and inadmissible for any purpose, including impeachment or estoppel, in any other litigation or proceeding; provided that evidence shall not be rendered inadmissible or non-discoverable solely as a result of its use in the dispute resolution proceedings.
13.4 Additional Provisions Relating to Dispute Resolution
All claims you bring against Luckee must be resolved in accordance with the provisions of this Agreement. All claims filed or brought contrary to these provisions shall be considered improperly filed and a breach of this Agreement. Should you file a claim contrary to this provision, Luckee may recover attorneys’ fees and costs (including in-house attorneys and paralegals) provided that Luckee has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim. You agree that any cause of action arising out of or related to the Service must commence within one (1) year after the cause of action accrues; otherwise, the cause of action is permanently barred. Any arbitration under this Agreement will only be on an individual basis. Class arbitrations, class actions, private-attorney general actions, and consolidation with other arbitrations are not permitted. You therefore waive your right to participate in a class action against Luckee. You agree that the relevant Courts in Nigeria with jurisdiction on these Terms, are the proper forums for any appeals of an arbitration award or for court proceedings in the event that this Agreement's binding arbitration clause is found to be unenforceable.

14. Termination of Your Access to Our Platform
14.1 Our Right to Terminate or Suspend Your Access
We have the right, at our discretion and without liability to you, with or without prior notice or with or without your consent, to temporarily terminate or permanently terminate your access to all parts or any part of our Platform via any technically available methods. In cases of violation of these Terms, we reserve the right to remedy such violations in accordance with law and in equity, including without limitation, the right to restrict, suspend, or terminate your Account or deny you access to our Platform without notice; and whenever the need to cooperate with law enforcement regarding enquiries or need to comply with law arises, we shall be entitled to disclose information including, your user identity, and personal details. You agree that we reserve the right to cancel transactions, restrict, or terminate your Account without notice, including but not limited to, the following situations:
a. Where you are using the Platform for money laundering or any illegal activity;
b. Where you have engaged in fraudulent activity;
c. Where either you, as an individual or an entity, or your bank account or wallet address is listed on the Specially Designated Nationals and Blocked Persons List (“SDN List”), Consolidated Sanctions List (“Non-SDN Lists”), or any other sanctions lists administered by the Office of Foreign Assets Control (OFAC), wanted list administered by the Economic Financial Crimes Commission (EFCC), or the red notice administered by the Interpol, or any other global or regional law enforcement agencies;
d. Where your Account is subjected to operational error or other errors which may require us to suspend your account pending when such errors are treated;
e. Where we have reason to believe that another Luckee Account provided by us or one of our group companies is held by you and has been used for any fraudulent activity, money laundering, terrorism financing, or other criminal activity;
f. Where you have otherwise acted in violation of these Terms. If we have a reasonable suspicion that you are utilizing the Site for illegal purposes, we reserve the right to take whatever action we deem appropriate.
Regarding suspension, you agree that we may suspend your Account at any time if:
a. We reasonably believe that your Account has been compromised or for other security reasons; or
b. We reasonably suspect that your Account has been used or is being used without your authorization or used fraudulently.
We shall notify you either before the suspension or, if prior notification is not possible under the circumstances, promptly after the suspension unless we are prohibited by law to notify you.
14.2 Your Right to Terminate Your Access
You may terminate these Terms by closing your Account at any time. When you elect to close your Account with us, you are required to withdraw any remnant funds in your Wallet immediately. Where you do not do this and still proceed to close your Account, you agree that these funds will be deemed abandoned and we will be at liberty to assume all of such funds. If an investigation is pending at the time you close your Account, we may hold your funds as described herein. If you are later determined to be entitled to some or all of the funds in dispute, we will release those funds to you.
14.3 Effect of Termination
We will not be liable to you or any third party for termination of access to our Platform, deletion of your information or Account data, assumption of abandoned funds within your Wallet, or export of your information or Account data. We will not be liable to you for compensation or damages in connection with any termination or suspension of the Platform. Any termination of this Agreement does not relieve you of any obligations to pay any fees or costs accrued prior to the termination and any other amounts owed by you to us as provided in this Agreement.
15. Amendment of Terms
We may amend the Terms from time to time. The changes will not be retroactive. You should visit the Luckee website at https://www.luckee.ng/ regularly to check when the Terms were last updated (as displayed at the top of this document) and to review the current Terms. We will do our best to notify you of any amendments to the Terms that we consider likely to materially affect your rights and obligations. Any such notice will be posted on our Platform, or sent by email to the address associated with your Luckee account. The continued use of your Luckee account, after any amendment to these Terms, constitutes your acceptance of the Terms, as modified by such amendment. If you do not accept the Terms, or any amendment to them, you must immediately stop using our Platform and your Account. No amendment of the Games may have retrospective effects. All users registered up to the moment of the introduction of the amendment shall have equal rights. Each amendment shall be included in and form an integral part of these Terms and Conditions. No claim in respect of terms contained in previous versions of these Terms and Conditions will be enforceable against Luckee following the moment at which an amended version becomes available on our website. In the event that any of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full effect.
16. Breaches of these Terms
Without prejudice to Luckee’s other rights under these Terms, if you breach these Terms in any way, we may take such action as we deem appropriate to deal with the breach, including suspending your access to the Platform, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.
17. Miscellaneous Provisions
17.1. Assignment
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of the Luckee. We reserve the right to assign or transfer its rights and obligations under these Terms at its sole discretion.
17.2. Entire Agreement
These Terms, together with any applicable policies or agreements referenced herein, constitute the entire agreement between you and Luckee regarding the subject matter of these Terms and supersede all prior or contemporaneous communications and proposals, whether oral or written.
17.3. Waiver
No failure of Luckee to exercise, or delay by Luckee in exercising, any right, remedy, power, or privilege arising from this Agreement shall operate or be construed as a waiver thereof, nor shall any single or partial exercise of any right, remedy, power, or privilege hereunder preclude any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege. No agency, partnership, or joint venture has been created between you and Luckee as a result of this Agreement. You do not have any authority of any kind to bind Luckee in any respect whatsoever.
